ON- LINE Membership Your sign in requires your off-line membership in the Seoul Foreign Correspondents' Club and your acceptance of terms. ---- Acceptance of Terms [Chapter 1 General Rules] Article 1(The Purpose) Seoul Foreign Correspondents' Club (hereunder called "SFCC") The purpose of this statement is that to define the service and the terms and conditions of service that the Seoul Foreign Correspondents' Club provides on its homepage, www.sfcc.or.kr. Article 2. (Validity and amendment of Terms of Service) ¨ç This article has validity as explained in previous emails. ¨è The SFCC may update its terms of service and update the terms of service as explained in Article1-¨ç. Article 3. Criterion Those details not mentioned here are covered under the Electro Communication organic law, Electro Communication Business law, and other laws regarding communication in Korea. However, the BY-LAWS and CONSTITUTION of the SFCC take precedence over the Electro Communication organic law, Electro Communication business law, and other related laws. Article 4. (Terms of Service) The terms of service are described below. ¨ç Member: a person who contracted for the SFCC Service and received a user name. He /she is approved for his /her use of the SFCC homepage by the SFCC. Members are categorized below. 1. Members in club are correspondent members, associate members, corporate members, domestic journalist members, and honorary members. 2. Special members are those who are or were once SFCC off-line members whose on-line memberships are carefully and individually approved by the board members of the SFCC. ¨è ID : to identify a member's membership, ID word is chosen by each member and approved by the SFCC board. ¨é Password: Chosen and made up of letters and numbers by a member for his or her on-line SFCC membership and for his or her protection. ¨ê E-Mail : mailing service available through internet ¨ë Webmaster : A person or persons selected by the SFCC for administration and management of SFCC homepage. [Chapter 2. Service contract] Article 5. (Conclusion of Service provision) ¨ç When the members clicks the 'I accept' in the response to the question "Do you accept the Terms of Service", he / she is considered to agree with the Terms of Service. ¨è When the member does not accept the updated Terms of Service, he/she may quit his/her use of service and withdraw his/her use of service and membership of SFCC homepage. When the member keeps using the service after the update of Terms of Service, he/she is considered to accept the updated Terms of Service. ¨é The Contract is concluded as SFCC approves member's request of service after he/she accepts the Terms of Service. ¨ê SFCC may not approve the request of members who do not conform to Article 7. Article 6. (Withdrawal and deprivation of membership) ¨ç Members can request SFCC to cancel his/her membership registration and SFCC will process your request in next 24 hours of SFCC working hours. ¨è If a member has committed violations as listed in Article 7 ¨è, Article 8 ¨è and ¨é, Article 11, Article 13, Article 18, Article 20, and Article 22, his/her membership may be suspended or canceled. The member will then be informed and will have a chance to provide explanation. 1. Filling wrong information on application 2. Disturbing the use of SFCC or others or embezzling the information of the SFCC and its members. 3. Violating terms of service of SFCC, public morals, or laws of Korea by using the SFCC. Article 7 (Service Request) ¨ç Members are required to fill in all necessary information on the registration application form to use SFCC on-line service. ¨è A person who did not provide the real information of himself or herself or provided wrong names may not have legal protection or use of service. Article 8 (Approval of service request) ¨ç SFCC approves the service request unless it does not come under Article 5, 6, and 7. ¨è SFCC, however, may postpone its admission under the following circumstances: 1. When the SFCC cannot afford the convenience of service 2. When there are technical impediments. 3. When SFCC otherwise admits it is necessary. ¨é SFCC may not admit an application for the following reasons: 1. When the passport number on application form is not his/hers or the name of a false person or pseudonym is used. 2. Used other false information is used on the application. 3. Applying for the purpose of misconduct against society's wellfaire and norms or morals. 4. When it does not meet the requisite terms of the SFCC service. Article 9 (Modifying Personal Information) A member is expected and has to modify his or her personal information on-line when there is any change in his/her personal information. A member is responsible for any problem caused by not modifying his/her personal information. [Chapter 3. Contracting parties' duties] Article 10 (SFCC's duties ) ¨ç The SFCC does not rent, sell, or share personal information of its members with other people without members' permission and shall not use members' personal information for commercial purposes but as a service for its members. The followings, however, shall be exceptions. 1. Laws safeguarding the real-name financial system and confidentiality and laws of credit information. 2. The application of the organic laws for Electro communication, Electro Communication Industrial laws, district tax laws, consumer rights laws, laws of the Bank of Korea, the Criminal Procedure Code, etc. 3. Information that does not specify each individual member to promote statistics, academic or marketing research. 4. SFCC may share members' information with partners that promote events to provide better service for SFCC members 5. Business partners of SFCC providing service for SFCC members. ¨è as above, ¨ç, it is up to the SFCC to decide to use the statistical information derived from members' personal information. ¨é SFCC shall supply any information recognized as valuable for members after taking proper procedures upon its members' wishes as requested in email or regular mail service. ¨ê SFCC may settle a complainant from a member within the laws. When more time is needed, the SFCC shall inform members. Article 11 (Members' Obligations) ¨ç Members shall observe the following rules. 1.It is forbidden to collect, save and abuse another member's ID and personal information 2.It is forbidden to plagiarize data collected by the SFCC to use it for at publicity or broadcasting or offer it without disclosing the source or to use, modify, or reproduce publicity and broadcast material without SFCC approval in advance. 3.It is forbidden to violate a company or an individual's copyrighted material. 4. It is forbidden to circulate information, or figures containing contents against public order, social norms, etc. 5. It is forbidden to use the materials objectively judged to be associated with criminal activities. 6. Other conduct against other concerned regulations and laws: ¨è Members must observe competent laws and regulations in accordance with the terms of service. ¨é Members must observe regulations when posted or announced separately. ¨ê Members are not allowed to use SFCC services for profit without SFCC approval in advance. [Chapter 4. Service provision and use] Article 12 (Service categories) This contract is applied to all service provided by SFCC, it may have separate subsidiary articles of terms of service if necessary. Article 13 (ID, and password and security) A member is responsible for maintaining and the confidentiality of the password and ID. A member is liable for any problem caused by abuse or negligent management of his/her ID and password. The SFCC is not liable for violations of Article 13. ¨è If a member's ID is used wrongfully or in violation of safety regulations, he/she must report in fraction to SFCC. Article 14 (Providing Information) The SFCC may send emails or regular mails only if the SFCC understands the need of various informations required to have access to SFCC service. Article 15 (Advertisers) SFCC is not liable to any damage or loss caused by its members who participated in advertiser's promotion and service provided and displayed by an advertiser on the SFCC homepage. Article 16 (Content displayed by SFCC members) The SFCC shall not have either civil liability or penal responsibility for any content posted, emailed, or transmitted by its members. The SFCC may expurgate without notice to its members in advance if any content for the following reasons: ¨ç Contents that harass, invade privacy of other members or individuals, or slander reputation of other members or individuals. ¨è Contents that threaten the stable service management of the SFCC ¨é Content associated into criminal conduct ¨ê Contents that violate intellectual rights and other rights of SFCC and others. ¨ë Contents that violate other related regulations and laws. Article 17 Copyrights and Duties of Content displayed on SFCC Homepage ¨ç Copyrights of all contents posted on the SFCC homepage belong to the SFCC in the absence of any different declaration of intention of the parties. ¨è The authority to protect contents belongs to the SFCC, and it is not allowed to post or quote material on another homepage without SFCC approval. ¨é Members shall not send junk mails, spam mails, or contents of harassing nature against social norms. ¨ê In accordance with Article 53 of Electro Communication law, enforcement Ordinance Article 16 of Electro Communication business law, Article 16 Clause 3 of Communication Business Law, the SFCC shall not have any legal responsibility for transmission of lascivious or improper material. ¨ë The IDs and email addresses of members who use the service at the SFCC homepage to harass or damage another person shall not be protected. Article 19 (Service hours) Service is available 24 hours a day throughout the year unless there are technical or administrational impediments or another proper reason. However, some or all the service shall be limited if: It is necessary for facility inspection; by the webmaster conduct; there are difficulties to reach SFCC service due to technical problems and congestion of service. ¨è Some of the service of SFCC may have a time limit, which shall be announced in advance. Article 20 (responsibility of use of service) Members are not allowed to sell property an illegal property or for such purposes as hacking, posting commercials, setting up lascivious webpages, circulating illegal software or programs. The SFCC is not liable to legal procedures on loss of sales incurred in such activity or arrest as a result of violating this article. Article 21, Restriction or suspension of service ¨ç SFCC may restrict or suspend SFCC service in case of wartime, calamity, or disaster, such state of national emergency, or suspension if by the central communication company of communication service in accordance with the Electro Communication Business law, or due to other irresistible force. ¨è When it is required to restrict or suspend its service, the SFCC has to notify members of the reason and the period fi time to in accordance with the above, ¨ç. [Chapter 5. Others] ¨ç A member must apply with contract termination himself /herself, when he/she wishes to terminate his/her service contract. ¨è SFCC may terminate a contract with a member without prior notice or limit its service if he/she engages in the followings conduct: 1. Abuses another person's service ID and password. 2. Disturb SFCC service administration on purpose 3. Intentionally circulates content against public order or customs. 4. Uses the service to impede national and public interest. 5. Harasses or damages another person's honor or reputation. 6. Transmits quantitative information or commercial information with the intention of disturbing the administration stability of SFCC service. 7. Circulate programs with a computer virus that cause malfunction and data destruction of information communication facilities. 8. Violate intellectual property rights of SFCC, its members, and others 10. Abuse personal information, ID, or password of another person 11. Conducts reproduction, circulation, or commercial use of data collected at without approval. 12. Displays and posts direct linkage to lascivious contents on his/her homepage and bulletin board 13. Violates of this contract, and other SFCC contracts and other related laws of Korea. Article 23 (Compensation for damages) The SFCC does not have responsibility for any damage incurred by its members and their use of SFCC service. Article 24 (Exemption article) ¨ç The SFCC is not capable of providing service to its members due to natural disaster or so forth. ¨è The SFCC is not responsible for any damage caused by information given by the SFCC. Members must make their own decisions to use such information. ¨é The SFCC is not liable for any service impediment caused by its member. ¨ê The SFCC is not responsible for a member who does not take service provided by SFCC or an individual member's decision of use service data. ¨ë The SFCC is not liable for the information, source, reliability, and accuracy of content displayed by its members. Article 25 (Competent Court) If a lawsuit is prosecuted concerning service, the Seoul district court is the competent court.
